The Three Core Pillars of the CCMA:

The Conciliation, Mediation and Arbitration Center (CCMA) of CAMARBRA is based on three clear pillars, designed to efficiently meet the demands of the Latin American commercial environment.

The first pillar is Solid Institutional Backing: The Center is directly supported by an international chamber of commerce with a firmly consolidated presence across the Latin American market. This unrivaled proximity empowers the Center to fully grasp the intricate commercial, cultural, and regulatory dynamics underlying cross-border operations between the involved sovereign nations.

The second pillar is its suggested list of arbitrators and mediators, carefully compiled with consideration and attention to the strategic sectors of commercial relations in Portuguese-speaking and Spanish-speaking countries.

This selection process is designed to guide parties in choosing professionals with concrete experience in the regional market and a solid track record in alternative dispute resolution methods. These specialists work in areas such as agribusiness, infrastructure, technology, and business contracts, which contributes to more objective analyses and decisions aligned with business realities. Arbitrators and mediators can also be chosen for their fluency in Portuguese, Spanish, and English, which facilitates the handling of transnational disputes in Latin America and with Latin American countries.

The third pillar lies in its competitive pricing. The Center’s lean structure, combined with the intensive use of technology to optimize procedures, allows for the efficient and agile handling of conflicts at reduced costs, often lower than those charged by larger centers. Furthermore, CCMA has an office in São Paulo/SP, with a space equipped with the appropriate infrastructure for conducting hearings.

Conciliation

It is a practical and collaborative way to resolve conflicts, focused on finding quick and effective solutions. With the support of an experienced conciliator, who guides the dialogue and encourages the building of understanding, the parties are encouraged to reach an agreement consensually. The suggestions presented serve as support for the negotiation, always with complete freedom to make decisions.

Mediation

It is a method focused on building sustainable solutions aligned with the interests of the parties. Guided by an impartial mediator, the process encourages productive dialogue, strengthens communication, and creates a favorable environment for the parties themselves to jointly construct the best solution, preserving existing relationships and encouraging the maintenance of business partnerships.

Arbitration

It is a safe and efficient way to resolve conflicts, in which the parties themselves choose who will decide the controversy. Arbitrators are selected for their technical knowledge and experience in the sector involved, which guarantees more qualified analyses and decisions aligned with the reality of the business. The arbitral decision has legal force and binding character, offering the parties predictability, legal certainty and speed, with the same value as a court judgment.
